Contest Rules
1. The AshTrap’s “Win an AshTrap – You Choose the Size” contest start date is 8:00 a.m. EST, July 03, 2006, and the closing date is 4:59:59 p.m. EST December 31, 2006 (the “Contest Period”). NO PURCHASE NECESSARY.
2. To Enter: To enter and be eligible to win, entrants must visit http://www.theashtrap.com/ and complete in full the on-line contest entry form. Limit of one entry per person or per e-mail address throughout the contest period. Entrants will have until December 31, 2006 at 4:59:59 p.m. EST (the “Closing Date”) to visit the Web http://www.theashtrap.com/ and enter the contest. Entries become the property of AshTrap and will not be returned. The AshTrap is not responsible for entries that may be lost, damaged, misdirected, illegible, delayed or not received.
3. Prize(s): One (1) prize will be awarded consisting of an AshTrap product. The winner of the AshTrap can choose the size of the product and has a choice of a 8’’ or 12’’ width of the product . Odds of winning depend on the total number of eligible entries received at the date and time of drawing.
4. Eligibility: The Contest is open to all legal residents of the United States and Ontario Canada and must be sixteen (16) years of age or older on the day the entry is submitted. Employees of AshTrap, its affiliated companies and associated resort properties, its representatives or agents, advertising or promotional agencies, prize suppliers/sponsors and members of their immediate families (spouses, children, siblings, and parents) or those living in the same household, are not eligible. Contest is void where prohibited or restricted by law. The Contest is subject to all applicable federal, state/provincial, and local laws and regulations. By participating, entrants agree to abide by and be bound by these Official Contest Rules and to accept the decisions of AshTrap as final.
5. Winner Selection: The Prize random draw will be conducted by independent judges and will be held in Welland, Ontario on, or about, December 31, 2006 at 5:00:00 p.m. EST from all eligible entries.
6. Prize Winner Notification: Winner (or the parent/legal guardian of a minor) will be required to sign and return the standard Declaration and Release Form and consent to the use of their name, city and/or photograph, without further compensation, in any marketing or publicity carried out by Ash Trap or their representatives or its advertising, marketing and promotions firm relative to this contest. Winners will be notified by telephone, mail, email or courier. The prize will be forfeited if the prize notification is returned as non-deliverable, if the Declaration and Release Form is not returned within 21 days from the time the prize notification package was sent. Any taxes, fees or incidental charges applicable to any prize shall be the sole responsibility of the winner of the prize.
7. Additional Terms: By participating, entrants agree to: (a) these Official Contest Rules and the decisions of AshTrap, which shall be final in all respects; and (b) release, discharge, indemnify and hold harmless AshTrap, each of its respective subsidiaries, affiliates, officers, directors, and employees, including their promotional agencies, from any liability, claims, or damages, demands, actions, or causes of action whatsoever which they, their heirs, successors, assigns, executors, or administrators may now or hereafter have directly or indirectly against them or any of them in respect of or relating to the Contest and/or the acceptance or use, misuse, or possession of any prize.
8. Limitation of Liability: AshTrap shall not be responsible for print or typographical errors in any Contest-related materials; for stolen, lost, late, misdirected, damaged, incomplete, illegible, or postage-due requests; or for prize claims that are posted late or incorrectly or are lost due to computer or electronic malfunction. AshTrap reserves the right to cancel or modify the Contest if fraud or technical failures compromise the integrity of the Contest as determined by AshTrap in its sole discretion.
9. Liability: The winners, and those accepting the prizes with the winners, agree that the prizes are awarded on the condition that AshTrap and its resort properties have no liability whatsoever for injuries, losses, or damage of any kind resulting from the participation in the drawing or resulting from the use or acceptance of any prize or participating in any prize-related activities.
10. Limitation of Technical Liability: All entries/prize claims become the property of the AshTrap, which assumes no responsibility for lost, stolen, delayed, damaged or misdirected entries or for any failure of the web site during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or entry to be received by AshTrap on account of technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or down-loading any material in the promotion. AshTrap reserves the right, in its sole discretion, to cancel or suspend this contest should a virus, bug or other cause beyond the reasonable control of AshTrap corrupt the security or proper administration of the contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, AshTrap reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries and prize claims are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way.
11. Dispute Resolution: Subject to other legal rights and remedies available to you under applicable provincial consumer protection laws, and subject to your consent, you agree that a simplified arbitration proceeding by a sole arbitrator shall be the initial recourse used to resolve any claim or dispute (whether originating in contract or tort, or pursuant to any applicable statutes, regulations or common law principles and whether past, present or future) that arises out of or is related to: (a) these Contest Rules; (b) any oral or written statements; or (c) any promotions or advertisements related to the Contest. You and sponsor will make every reasonable effort to agree on the appointment of the arbitrator within fifteen (15) days of the commencement of the arbitration proceeding, failing which, the arbitrator will be appointed by the court in the province in which you reside. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party.
